By using the services offered by Stadium Car Parks here forth referred to as “the Company”, "we", "us" or "our") you are agreeing to the terms and conditions (here forth referred to as “the Terms” or “this Agreement”) set out below which apply to the use of both the website and the services offered on it. These Conditions apply to all services provided by the Company to any visitors to the site or users of our site (here forth referred to as “the Customer” or “you”) and prevail over the conditions of business of any of the car parks available for use. The Company reserves the right, at its discretion, to refuse service to any Customer without justification.
All payments made through and purchases made from StadiumCarParks.co.uk (here forth referred to as “the Website” or “the Site”) are bound by these Terms and Conditions at any time although the Terms and Conditions governing any given purchases will be those in effect at the date your order is placed. If you place an order at any time after we have published any amendments or additions, you will be bound by those changes. Accordingly, you should check prior to each purchase to ensure that you understand the precise terms and conditions applicable to your purchase. Continuing use of the Site and our services will constitute acceptance of the existing terms and conditions.
1. Your obligations and responsibilities
When accessing or using our site, services or products, you are bound by these Terms and Conditions. You shall always act in accordance with the law, custom and in good faith. You may not make any change or alteration to the Site or any content or services that may appear on the Site and may not impair in any way the integrity or operation of the Site. Without limiting the generality of any other provision of these Terms and Conditions, if you default negligently or willfully in any of the obligations set forth in these Terms and Conditions you shall be liable for all the losses and damages that this may cause to the Company, our affiliates, partners or licensors.
2. Booking Confirmation
2.1 Once an application and payment has been received you will receive a confirmation by email (here forth referred to as your “e-ticket”), this email will contain your unique booking reference number, vehicle details and car park address.
2.2 In the event that you fail to produce your booking reference number on arrival at the car park, you may be refused entry and fees payable on booking are non-refundable.
2.3 The Company will provide the address of the car park in the booking confirmation but it is the Customers responsibility to ensure that they understand the location of the car park and are able to find it. We accept no responsibility for failure to find the car park and are unable to provide support or directions should the Customer be unable to find it. The fees paid on booking are non-refundable in the event that the Customer is unable to locate the car park in time and fails to use the space.
3. E-tickets
3.1 It is the Customers responsibility to print and present your e-ticket to the attendant at the car park in order to be allowed access to the car park. Failure to do so may lead to the Customer being refused entry to the car park.
3.2 We reserve the right to refuse entry to the car park to any Customer who fails to produce the correct and valid e-ticket or booking reference number.
3.3 We issue e-tickets to our Customers specific to their vehicles to ensure we can process their application and assist on arrival as efficiently and quickly as possible. In turn, we require that Customers ensure that you have submitted the correct vehicle make and information in your application as failure to do so can result in you being denied access to the car park.
3.4 For the reasons discussed in section 3.3 of these Terms, your reservation and/or e-ticket cannot be transferred to another individual or vehicle without our express written permission.
4. Arrival
4.1 The Parking Pass that is issued to those individuals who are using our service is only valid for the customer to whom it has been issued and can not be transferred without our express written permission.
4.2 Possession of a Parking Pass does not entitle the Customer to a particular parking space in the Car Park or priority over other Customers under any circumstances unless otherwise specified.
4.3 Failure to produce the correct and valid booking reference number on arrival will lead to Customers wishing to use the car park being required to pay the full amount for use of the car park on the gate. This amount will be refunded in full should you then produce your booking reference at a later date for the Company to verify that it was for the date and vehicle that was previously paid for.
4.4 Access will not be permitted to any Customers or vehicles that arrive outside of the standard car park opening times of 4 hours prior to the event start time unless confirmed in writing prior to the event date.
5. Your Obligations and Responsibilities
5.1 The Company are unable to offer any guarantees in relation to the security of your goods and possessions and require that all Customers follow the following guidelines:
- Ensure all windows of your vehicle are securely closed and locked where possible;
- Ensure your vehicle is securely locked;
- Ensure you do not leave any possessions in the car where possible, particularly valuable items that may attract unwanted attention such as Sat Nav’s, phones etc; and
- Ensure any possessions that are left in the vehicle are not visible and are hidden away or where possible, locked away.
5.2 We require that any Customers using the car parks drive carefully and obey any and all directions, signs and instructions within the car park.
5.3 For the safety of both our Customers and other individuals, we request that once you have parked your vehicle, you proceed to the nearest exit in the safest but quickest manner possible. It is likely that there will be many cars moving around the car park at any one time so it is essential that any children you have with you are moved out of the vicinity as soon as possible.
5.4 We require that Customers using the Car Parks remove their vehicle within 2 hours of the end of the event. We reserve the right to remove any vehicle which we have reasonable grounds to believe has been abandoned.
6. Liability
We promise to exercise reasonable care and skill in carrying out our obligations under this Agreement. In return, we require that you:
- agree to park your vehicle in the car park at your own risk;
- use the parking space provided by us for parking purposes only; any other activity is strictly prohibited unless otherwise stated.
- hold valid Third Party Insurance for the vehicle that will be parked in the car park.
- will not hold the Company responsible or liable for any direct, indirect or consequential loss including but not restricted to death, damage, destruction, loss, theft or injury to your or a third party associated with the booking you have made arising out of or in connection with any act or omission of either (“We”) the company or any agent or representative acting on our behalf.
To the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to the Products. This does not affect your statutory rights as a consumer, nor does it affect your Contract Cancellation Rights.
We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with the Conditions for any economic losses (including without limitation loss of revenues, profits, contracts, business or anticipated savings), or any loss of goodwill or reputation; or any special or indirect losses suffered or incurred by that party arising out of or in connection with the provisions of any matter under the conditions. Nothing in the Conditions shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees.
7. Cancellations and Refunds
Cancellations confirmed 48 hours before the event date will be subject to a £5 admin charge. Reservations which have been submitted for an incorrect date will also be subject to a £5 charge. Cancellations will not be accepted and refunded within 48 hours from the event date and therefore no refund will be issued.
We will do our best to ensure that all information, descriptions, photographs and prices of products appearing on the Site are correct at the time when the relevant information was entered onto the system. Though we aim to keep the Site as up to date as possible, the information including car park descriptions appearing on this Site may not always reflect the product exactly at the moment you place an order.
8. The Site
While we will use reasonable endeavors to verify the accuracy of any information we place on the Website, we make no warranties, whether express or implied in relation to its accuracy. The Website is provided on an "as is" and "as available" basis without any representation or endorsement made and we make no warranties of any kind, whether express or implied, in relation to the Website, or any transaction that may be conducted on or through the Website including but not limited to, implied warranties of non-infringement, compatibility, security, accuracy, conditions of completeness, or any implied warranty arising from course of dealing or usage or trade.
We make no warranty that the Website will meet your requirements or will be uninterrupted, timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the Website. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Website.
9. Third Party Links
To provide increased value to our Customers, we may provide links to other websites or resources for you to access at your sole discretion from our website. You acknowledge and agree that, as you have chosen to enter the linked website we are not responsible for the availability of such external sites or resources, and do not review or endorse and are not responsible or liable, directly or indirectly, for the privacy practices of such websites, the content of such websites, including (without limitation) any advertising, content, products, goods or other materials or services on or available from such websites or resources or the use to which others make of these websites or resources, nor for any damage, loss or offence caused or alleged to be caused by, or in connection with, the use of or reliance on any such advertising, content, products, goods or other materials or services available on such external websites or resources.
10. Validity
If any of these Terms and Conditions is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Terms and Conditions which will continue to be valid and enforceable to the fullest extent permitted by law.
11. Indemnity
The Company are not responsible for any loss, damages or costs, including reasonable legal fees, resulting from any third party claim, action, or demand resulting from your use of the Site. You also agree to indemnify us for any loss, damages, or costs, including reasonable legal fees, resulting from any action you take that imposes an unreasonable burden or load on our infrastructure.
12. Law
The Terms and Conditions will be governed by English law and the parties submit to the exclusive jurisdiction of the English courts in relation to any dispute which may arise between them.
